Government agents can sneak onto your property in the middle of the night, put a GPS device on the bottom of your car and keep track of everywhere you go. This doesn't violate your Fourth Amendment rights, because you do not have any reasonable expectation of privacy in your own driveway — and no reasonable expectation that the government isn't tracking your movements.
That is the bizarre — and scary — rule that now applies in California and eight other Western states. The U.S. Court of Appeals for the Ninth Circuit, which covers this vast jurisdiction, recently decided the government can monitor you in this way virtually anytime it wants — with no need for a search warrant.
It is a dangerous decision — one that, as the dissenting judges warned, could turn America into the sort of totalitarian state imagined by George Orwell. It is particularly offensive because the judges added insult to injury with some shocking class bias: the little personal privacy that still exists, the court suggested, should belong mainly to the rich...
The judges veered into offensiveness when they explained why Pineda-Moreno's driveway was not private. It was open to strangers, they said, such as delivery people and neighborhood children, who could wander across it uninvited.
Chief Judge Alex Kozinski, who dissented from this month's decision refusing to reconsider the case, pointed out whose homes are not open to strangers: rich people's. The court's ruling, he said, means that people who protect their homes with electric gates, fences and security booths have a large protected zone of privacy around their homes. People who cannot afford such barriers have to put up with the government sneaking around at night.
Judge Kozinski is a leading conservative, appointed by President Ronald Reagan, but in his dissent he came across as a raging liberal. "There's been much talk about diversity on the bench, but there's one kind of diversity that doesn't exist," he wrote. "No truly poor people are appointed as federal judges, or as state judges for that matter." The judges in the majority, he charged, were guilty of "cultural elitism."
The court went on to make a second terrible decision about privacy: that once a GPS device has been planted, the government is free to use it to track people without getting a warrant. There is a major battle under way in the federal and state courts over this issue, and the stakes are high. After all, if government agents can track people with secretly planted GPS devices virtually anytime they want, without having to go to a court for a warrant, we are one step closer to a classic police state — with technology taking on the role of the KGB or the East German Stasi.
Fortunately, other courts are coming to a different conclusion from the Ninth Circuit's — including the influential U.S. Court of Appeals for the District of Columbia Circuit. That court ruled, also this month, that tracking for an extended period of time with GPS is an invasion of privacy that requires a warrant. The issue is likely to end up in the Supreme Court.
In these highly partisan times, GPS monitoring is a subject that has both conservatives and liberals worried. The U.S. Court of Appeals for the D.C. Circuit's pro-privacy ruling was unanimous — decided by judges appointed by Presidents Ronald Reagan, George W. Bush and Bill Clinton.
Plenty of liberals have objected to this kind of spying, but it is the conservative Chief Judge Kozinski who has done so most passionately. "1984 may have come a bit later than predicted, but it's here at last," he lamented in his dissent. And invoking Orwell's totalitarian dystopia where privacy is essentially nonexistent, he warned: "Some day, soon, we may wake up and find we're living in Oceania."

George Orwell, the pen name by which Eric Blair is known, had the gift of prophecy, or else blind luck. In 1949 in his novel, 1984, he described the Amerika of today and, I fear, also his native Great Britain, which is no longer great and follows Washington, licking the jackboot and submitting to Washington’s hegemony over England and Europe and exhausting itself financially and morally in order to support Amerikan hegemony over the rest of the world.
In Orwell’s prophecy, Big Brother’s government rules over unquestioning people, incapable of independent thought, who are constantly spied upon. In 1949 there was no Internet, Facebook, twitter, GPS, etc. Big Brother’s spying was done through cameras and microphones in public areas, as in England today, and through television equipped with surveillance devices in homes. As everyone thought what the government intended for them to think, it was easy to identify the few who had suspicions.
Fear and war were used to keep everyone in line, but not even Orwell anticipated Homeland Security feeling up the genitals of air travelers and shopping center customers. Every day in people’s lives, there came over the TV the Two Minutes of Hate. An image of Emmanuel Goldstein, a propaganda creation of the Ministry of Truth, who is designated as Oceania’s Number One Enemy, appeared on the screen. Goldstein was the non-existent "enemy of the state" whose non-existent organization, "The Brotherhood," was Oceania’s terrorist enemy. The Goldstein Threat justified the "Homeland Security" that violated all known Rights of Englishmen and kept Oceania’s subjects "safe."
Since 9/11, with some diversions into Khalid Sheik Mohammed and Mohamed Atta, the two rivals to bin Laden as the "Mastermind of 9/11," Osama bin Laden has played the 21st century roleof Emmanuel Goldstein. Now that the Obama Regime has announced the murder of the modern-day Goldstein, a new demon must be constructed before Oceania’s wars run out of justifications.
Hillary Clinton, the low-grade moron who is US Secretary of State, is busy at work making China the new enemy of Oceania. China is Amerika’s largest creditor, but this did not inhibit the idiot Hilary from, this week in front of high Chinese officials, denouncing China for "human rights violations" and for the absence of democracy.
While Hilary was enjoying her rant and displaying unspeakable Amerikan hypocrisy, Homeland Security thugs had organized local police and sheriffs in a small town that is the home of Western Illinois University and set upon peaceful students who were enjoying their annual street party. There was no rioting, no property damage, but the riot police or Homeland Security SWAT teams showed up with sound cannons, gassed the students and beat them.
Indeed, if anyone pays any attention to what is happening in Amerika today, a militarized police and Homeland Security are destroying constitutional rights of peaceful assembly, protest, and free speech.
For practical purposes, the U.S. Constitution no longer exists. The police can beat, taser, abuse, and falsely arrest American citizens and experience no adverse consequences.
The executive branch of the federal government, to whom we used to look to protect us from abuses at the state and local level, acquired the right under the Bush regime to ignore both US and international law, along with the US Constitution and the constitutional powers of Congress and the judiciary. As long as there is a "state of war," such as the open-ended "war on terror," the executive branch is higher than the law and is unaccountable to law. Amerika is not a democracy, but a country ruled by an executive branch Caesar.
Hillary, of course, like the rest of the U.S. Government, is scared by the recent International Monetary Fund (IMF) report that China will be the most powerful economy in five years.
Just as the military/security complex pressured President John F. Kennedy to start a war with the Soviet Union over the Cuban missile crisis while the US still had the nuclear advantage, Hillary is now moving China into the role of Emmanuel Goldstein.
Hate has to be mobilized, before Washington can move the ignorant patriotic masses to war.
How can Oceania continue if the declared enemy, Osama bin Laden, is dead. Big Brother must immediately invent another "enemy of the people."
But Hillary, being a total idiot, has chosen a country that has other than military weapons. While the Amerikans support "dissidents" in China, who are sufficiently stupid to believe that democracy exists in Amerika, the insulted Chinese government sits on $2 trillion in US dollar-denominated assets that can be dumped, thus destroying the US dollar’s exchange value and the dollar as reserve currency, the main source of US power.
Hillary, in an unprecedented act of hypocrisy, denounced China for "human rights violations." This from a country that has violated the human rights of millions of victims in our own time in Iraq, Afghanistan, Pakistan, Yemen, Libya, Somalia, Abu Ghraib, Guantanamo, secret CIA prisons dotted all over the planet, in US courts of law, and in the arrests and seizure of documents of American war protestors. There is no worst violator of human rights on the planet than the US government, and the world knows it.
The hubris and arrogance of US policymakers, and the lies that they inculcate in the American public, have exposed Washington to war with the most populous country on earth, a country that has a military alliance with Russia, which has sufficient nuclear weapons to wipe out all life on earth. The scared idiots in Washington are desperate to set up China as the new Osama bin Laden, the figure of two minutes of hate every news hour, so that the World’s Only Superpower can take out the Chinese before they surpass the US as the Number One Power.
No country on earth has a less responsible government and a less accountable government than the Americans. However, Americans will defend their own oppression, and that of the world, to the bitter end.

This case began in 2007, when Drug Enforcement Administration (DEA) agents decided to monitor Juan Pineda-Moreno, an Oregon resident who they suspected was growing marijuana. They snuck onto his property in the middle of the night and found his Jeep in his driveway, a few feet from his trailer home. Then they attached a GPS tracking device to the vehicle's underside.
After Pineda-Moreno challenged the DEA's actions, a three-judge panel of the Ninth Circuit ruled in January that it was all perfectly legal. More disturbingly, a larger group of judges on the circuit, who were subsequently asked to reconsider the ruling, decided this month to let it stand. (Pineda-Moreno has pleaded guilty conditionally to conspiracy to manufacture marijuana and manufacturing marijuana while appealing the denial of his motion to suppress evidence obtained with the help of GPS.)
In fact, the government violated Pineda-Moreno's privacy rights in two different ways. For starters, the invasion of his driveway was wrong. The courts have long held that people have a reasonable expectation of privacy in their homes and in the "curtilage," a fancy legal term for the area around the home. The government's intrusion on property just a few feet away was clearly in this zone of privacy.

Orwell in charge? Kucinich compares Iraq ‘exit’ to Bush’s ‘Mission Accomplished’

"Congressman Dennis Kucinich (D-OH) today challenged the notion that removing ‘combat brigades’ but leaving 50,000 U.S. troops in Iraq constitutes an end to combat operations, let alone an end to the war," a press release sent to RAW STORY on Thursday stated.
The press release continues:
“Who is in charge of our operations in Iraq, now? George Orwell? A war based on lies continues to be a war based on lies. Today, we have a war that is not a war, with combat troops who are not combat troops. In 2003, President Bush said ' Mission Accomplished ' . In 2010, the White House says combat operations are over in Iraq , but will leave 50,000 troops, many of whom will inevitably be involved in combat-related activities.
“Just seven days ago, General Babaker Shawkat Zebari, the commander of Iraq ’s military, said that Iraq ’s security forces will not be trained and ready to take over security for another 10 years. One story is being told to the military on the ground in Iraq and another story is being told to their families back home.
“You can’t be in and out at the same time.
“This is not the end of the war; this is simply a new stage in the campaign to lull the American people into accepting an open-ended presence in Iraq . This is not an honest accounting to the American people and it diminishes the role of the troops who will put their lives on the line. This is not fair to the troops, their families or the American people.
“The Administration and the Pentagon would be wise to level with the American people about our long-term commitment to Iraq .
“The cost of the wars has been estimated to be around $1 million per soldier per year. Each year the troop levels stay at 50,000 means another $50 billion is wasted. I object to spending billions of dollars to maintain a charade in Iraq while our own economy is failing and over 15 million Americans are out of work. I object to keeping any level troops in Iraq to maintain a war based on lies. It is time that Congress sees through the manipulation and finally acts to truly end the war by stopping its funding,” said Kucinich.
Kucinich's statement doesn't mention President Obama's name once, but the president also didn't don a military jumpsuit and fly a plane onto a carrier with a gigantic "Mission Accomplished" banner.

Aside from Kucinich, RAW STORY was only able to find a scathing editorial on the World Socialist Web Site:
The White House and the Pentagon, assisted by a servile media, have hyped Thursday’s exit of a single Stryker brigade from Iraq as the end of the “combat mission” in that country, echoing the ill-fated claim made by George W. Bush seven years ago.
Obama is more skillful in packaging false propaganda than Bush, and no doubt has learned something from the glaring mistakes of his predecessor. Bush landed on the deck of the US aircraft carrier Abraham Lincoln on May 1, 2003 to proclaim—under a banner reading “Mission Accomplished”—that “major combat operations” in Iraq were over. A captive audience of naval enlisted personnel was assembled on deck as cheering extras.
Obama wisely did not fly to Kuwait to deliver a similar address from atop an armored vehicle. He merely issued a statement from the White House, while leaving the heavy lifting to the television networks and their “embedded” reporters, who accompanied the brigade across the border into Kuwait and repeated the propaganda line fashioned by the administration and the military brass.
Three years after former President George W. Bush declared "Mission Accomplished" on an aircraft carrier, MSNBC anchor Keith Olbermann proceeded to mock the early propagandistic call by announcing each successive night on his Countdown show that it has been "one thousand and blank" days since the the war in Iraq "ended," RAW STORY noted yesterday.
Chances are, three years from now, even if US troops are still caught up in a quagmire in Iraq, Olbermann won't be doing a similar signoff schtick to mock the coverage that ran on NBC and MSNBC Wednesday evening.
At The New York Times Media Decoder blog,, Brian Stelter reported, "The combat mission in Iraq doesn’t officially end until Aug. 31 but viewers and readers could be forgiven for thinking it ended tonight."
In a broadcast that Brian Williams said constituted an “official Pentagon announcement,” NBC showed live pictures Wednesday night as members of the last combat brigade in Iraq drove toward the Kuwait border, symbolizing an end to fighting in the country.
“We are with the last combat troops” in Iraq, the NBC correspondent Richard Engel said at 6:30 p.m. Eastern, the same time that the military lifted an embargo that had been placed on the reporters traveling with the 440 troops, a part of the 4/2 Stryker Brigade.
The Associated Press, Fox News, The Los Angeles Times, The Washington Post, Al Jazeera and other news media outlets also reported Wednesday evening that the last combat troops were crossing into Kuwait. Only NBC broadcast it live, in asymmetrical image to the invasion that captured the nation’s attention on television seven years ago.
Coverage by most media outlets on the "last combat brigade" leaving Iraq paint an almost rosy picture with their headlines, which suggest that not only will the close to 60,000 troops left behind not be fighting anyone, but that there is no chance of any future surge.
"As the United States military prepares to leave Iraq by the end of 2011, the Obama administration is planning a remarkable civilian effort, buttressed by a small army of contractors, to fill the void," the New York Times reports.
However, the Associated Press and many liberal blogs instead chose to criticize Fox News for not covering the "exit" with the same gusto.
Perhaps another network could have covered the extensive coverage MSNBC was provided by the Pentagon instead.

"Congressman Dennis Kucinich (D-OH) today challenged the notion that removing ‘combat brigades’ but leaving 50,000 U.S. troops in Iraq constitutes an end to combat operations, let alone an end to the war," a press release sent to RAW STORY on Thursday stated.
The press release continues:
“Who is in charge of our operations in Iraq, now? George Orwell? A war based on lies continues to be a war based on lies. Today, we have a war that is not a war, with combat troops who are not combat troops. In 2003, President Bush said ' Mission Accomplished ' . In 2010, the White House says combat operations are over in Iraq , but will leave 50,000 troops, many of whom will inevitably be involved in combat-related activities.
“Just seven days ago, General Babaker Shawkat Zebari, the commander of Iraq ’s military, said that Iraq ’s security forces will not be trained and ready to take over security for another 10 years. One story is being told to the military on the ground in Iraq and another story is being told to their families back home.
“You can’t be in and out at the same time.
“This is not the end of the war; this is simply a new stage in the campaign to lull the American people into accepting an open-ended presence in Iraq . This is not an honest accounting to the American people and it diminishes the role of the troops who will put their lives on the line. This is not fair to the troops, their families or the American people.
“The Administration and the Pentagon would be wise to level with the American people about our long-term commitment to Iraq .
“The cost of the wars has been estimated to be around $1 million per soldier per year. Each year the troop levels stay at 50,000 means another $50 billion is wasted. I object to spending billions of dollars to maintain a charade in Iraq while our own economy is failing and over 15 million Americans are out of work. I object to keeping any level troops in Iraq to maintain a war based on lies. It is time that Congress sees through the manipulation and finally acts to truly end the war by stopping its funding,” said Kucinich.
Kucinich's statement doesn't mention President Obama's name once, but the president also didn't don a military jumpsuit and fly a plane onto a carrier with a gigantic "Mission Accomplished" banner.

For reporting that is an embarrassment to the profession of journalism, and for being beholden to corporate paymasters rather than the citizens of America.
Too bad Lucianne Goldberg reached her zenith of infamy during the Clinton impeachment, because she would make a terrific BuzzFlash Media Putz recipient. But we can rectify that by recognizing the ongoing and significant contributions to the degradation of journalism made by her son, Jonah Goldberg.
His pedigree of Putzdom is unchallengeable. Just consider his recollection of his role in the pass-off of dirty linen from Monica Lewinsky to Linda Tripp to his Mom to Drudge to Ken Starr:
My mother was the one who advised Linda Tripp to record her conversations with Monica Lewinsky and to save the dress. I was privy to some of that stuff, and when the administration set about to destroy Lewinsky, Tripp, and my mom, I defended my mom and by extension Tripp... I have zero desire to have those arguments again. I did my bit in the trenches of Clinton's trousers.
Employed by the National Review Online, Jonah is one of those right-wing media shills who resides somewhere between Ann Coulter and David Brooks. You just don't know which side of him is going to show up at any given time when he regularly appears on the television "news analysis" programs or in his writings.
Take, for instance, his recent book whose title owes much to the Coulter school of sensational language: "Liberal Fascism." Its subtitle is "The Secret History of the American Left, From Mussolini to the Politics of Meaning." There's one of those annoying smiley faces on the bright red front cover, except this one has a Hitler moustache. Okay, was Jonah tripping when he came up with this book, or just drunk?
Because it just doesn't make any sense. I don't think anyone ever heard the words liberal and fascism attached before, let alone Mussolini included in a secret leftist history of America. That must have been some blotter acid Jonah, eh?
As a right-winger, you know that you have a problem on your hand when the "American Conservative" pans your tome: "Liberal Fascism reads less like an extended argument than as a catalogue of conservative intellectual clichés, often irrelevant to the supposed point of the book."
In the American Conservative article from January 28, 2007, the first paragraph gets to the heart of the absurdity of Goldberg's concept of "liberal fascism": "Not without reason was Jonah Goldberg's Liberal Fascism widely expected to be a bad book. As many predicted from the title, Goldberg does not content himself with rebuking those who call anyone who disagrees with them a fascist. Instead, he invents reasons of his own for calling anyone who disagrees with Jonah Goldberg a fascist. Liberal Fascism confirms anew George Orwell's remark -- cited by Goldberg without irony -- that fascism has no meaning today other than 'something not desirable.'"
Robert Morse of Indianapolis, Indiana, nominated Jonah Goldberg as the BuzzFlash Media Putz of the Week for connecting Hitler to liberals. In fact, Goldberg contends Hitler was a liberal.
Next time you see Jonah peddling his "views" on television, remember that he's living proof that the more you don't make sense, the higher your value rises in the right-wing punditsphere. "Right-Wing Fascism" would have made too much sense as a title, but then again Goldberg appears to specialize in fiction.
